# Terms of Service for KindEars

## 1. Acceptance of Terms

By downloading, installing, or using KindEars ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

## 2. Description of Service

KindEars is a free audio application for Android that provides:

- Music player for local audio files

- MIDI player with synthesizer support

- Internet radio streaming

- Audio editor with recording capabilities

- SoundFont SF2 Editor / Creator (Experimental, WIP)

## 3. License

KindEars is provided as free software. You are granted a non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

### You MAY:

- Use the App on any Android device you own

- Play audio files you legally own or have rights to

- Record internet radio streams for personal use (subject to local laws)

- Create and manage playlists

### You MAY NOT:

- Use the App for any illegal purpose

- Redistribute the App outside of official channels

- Use the App to infringe on others' copyrights

## 4. User Content

### Your Files

- You retain all rights to your audio files

- KindEars only accesses files you explicitly grant permission to

- The App does not upload your audio files anywhere

### Radio Recordings

- Recording internet radio streams may be subject to copyright laws in your jurisdiction

- You are solely responsible for ensuring your use complies with applicable laws

- Recordings are for personal use only

## 5. Internet Radio

The App provides access to internet radio stations through third-party services:

- Radio stations are provided by independent broadcasters

- We do not control or endorse the content of any radio station

- Station availability may change without notice

- Some stations may contain explicit content

## 6. Google Drive Sync

If you choose to use the Google Drive sync feature:

- You must have a valid Google account

- You agree to Google's Terms of Service

- We are not responsible for data loss due to Google Drive issues

- You can disable sync at any time

## 7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

- The App will be error-free or uninterrupted

- The App will meet your specific requirements

- Any errors will be corrected

- The App will be compatible with all devices

- The SoundFont Creator feature is experimental and may not work as expected

## 8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

- Any indirect, incidental, special, or consequential damages

- Loss of data, profits, or goodwill

- Device damage or malfunction

- Any damages arising from use or inability to use the App

The App may interact with third-party services:

- **Google Drive**: Subject to Google's Terms of Service

- **Radio Browser API**: Public service for radio station discovery

- **Internet Radio Stations**: Independent third-party services

We are not responsible for the availability, content, or policies of third-party services.

## 10. Intellectual Property

### Our Property

- The KindEars name, logo, and original code are our intellectual property

- Third-party libraries are used under their respective licenses (Apache 2.0, MIT, LGPL 2.1)

### Your Property

- Your audio files, playlists, and recordings remain your property

- We claim no ownership over your content

### Third-Party Property

- MIDI files, SoundFont files, music, and radio content may be protected by copyright 

- You must have legal rights or permission to use any content in the App 

- We are not responsible for copyright infringement by users

## 11. Updates and Changes

We may:

- Update the App to fix bugs or add features

- Modify these Terms at any time

- Discontinue the App or any feature without notice

Continued use after changes constitutes acceptance of modified Terms.

## 12. Termination

You may stop using the App at any time by uninstalling it.

We reserve the right to:

- Remove the App from distribution platforms

- Disable features that violate platform policies

- Refuse service to anyone for any reason
